Guardianship and ConservatorshipGuardianship is an appointment by the court that allows a person to make decisions about the care of another. Conservatorship is an appointment by the court that allows a person to manage the property and financial affairs of another. The most common situation where guardianship and/or conservatorship is sought is where a parent seeks to extend their parental rights over an emancipated disabled child, or a relative seeks to aid an ailing elderly. Seeking guardianship and/or conservatorship requires a great deal of paperwork, and may require two attorneys. If you are seeking guardianship or conservatorship for an emancipated disabled child or an ailing elderly that individual will need separate representation to ensure their interests are protected.
