Protective Orders

DO NOT PURSUE OR DEFEND BY YOURSELF! Protective orders are serious injunctions that carry significant consequences to your family and your lifestyle. Do not seek a protective order or defend against one without at least consulting an attorney.

FOR PETITIONERS (those seeking protection under the order) - If you've been the subject of abuse, or threats of abuse, and fear for your safety or the safety of your loved ones you should seek a protective order. Protective orders can apply criminal penalties upon the person who is hurting you for merely contacting you, showing up at a place you frequent, or even possessing a weapon.

All of the situations that lead to the necessity of a protective order are tragic and emotional. You need someone with knowledge and experience to walk you through the paperwork and the process, and to stand between you and your aggressor as an advocate in the courtroom.

My practice has helped people in Salt Lake, Davis, Weber, and Summit counties. I've worked for individuals from Ogden, Roy, Farmington, Layton, Centerville, Bountiful, North Salt Lake, Woods Cross, Clinton, Salt Lake City, Holladay, West Jordan, Taylorsville, and Park City. I have the knowledge and experience to help you.

FOR RESPONDANTS (Those being served with a protective order) - It has been my experience that on occasion a protective order is being sought without justification. The burden of proof on the party seeking the protective order is a looser standard than is found in the criminal court. I have seen protective orders granted against a presumably innocent party because that party did not understand the law or the process well enough to adequately defend themselves.

DO NOT DEFEND YOURSELF WITHOUT AT LEAST CONSULTING AN ATTORNEY! The consequences that attend a protective order start when the protective order is issued not just if a violation occurs. Safe Harbor and Legal Aid represent at no cost those seeking protective orders. The petitioner will have a lawyer and so should you.
